Copyright Modernization Act (Bill C-11) Receives Royal Assent:
Canada's Copyright Modernization Act (Bill-C-11) completed the legislative process on June 29, 2012. The new law is expected to come into force during fall 2012, bringing expanded fair dealing rights to education. UBC has compiled a helpful, brief overview of the changes you can expect.
The Supreme Court of Canada (SCC37) has reached five key decisions regarding the balance between fair dealing and the rights of copyright holders, with significant implications for education. Because of SCC37, the new Copyright Modernization Act (Bill C-11) and through discussions with our colleagues at other institutions, the Association of Canadian Community Colleges and Colleges Ontario Sault College made the decision under advisement to sever ties with Access Copyright. We are now following the educational exceptions within Bill C-11, the decisions of the Supreme Court and a landmark decision in libraries that set a precedent for this (on fair dealing), CCH Society of Upper Canada. August 31, 2012: Sault College has opted out the Access Copyright Interim Tariff and the Model Licence. The College will instead be operating under the expanded Fair Dealing exceptions for education within the Copyright Act.
